Terms of Service

These Terms of Service ("Terms") govern your use of the Infograph AI website and application at infograph.ai (the "Service") operated by Infograph AI ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Infograph AI is an AI-powered platform that transforms data into dashboards and visualizations. The Service allows you to upload data files, connect external data sources, interact with AI to generate dashboards, and share your work. The Service relies on third-party providers for infrastructure, AI models, payments, and authentication, and we cannot guarantee uninterrupted availability, performance, or uptime.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and, if acting on behalf of an organization, that you have authority to bind that organization to these Terms.

3. Accounts

You are responsible for maintaining the security of your account credentials and for all activity under your account. You must not share your credentials or allow unauthorized access. Notify us immediately at support@infograph.ai if you suspect unauthorized use.

4. Subscriptions and Billing

The Service offers free and paid plans. Paid plans are billed monthly or annually through Dodo, our merchant of record, and renew automatically unless canceled before the renewal date. Subscription fees are non-refundable except where required by applicable law. Dodo's terms govern payment processing, refund disputes, and billing inquiries.

If you downgrade or cancel your plan, you retain access to paid features until the end of your current billing period. After that, your account reverts to the free tier. Data exceeding free-tier limits will become inaccessible but is retained for 90 days before permanent deletion.

5. Credits

Certain features, including AI interactions, consume credits. Credits are prepaid, non-refundable, and have no cash value. Unused credits reset at the beginning of each billing period and do not roll over. Upon account termination for breach, all remaining credits are forfeited. Upon voluntary cancellation, credits remain available until the end of your billing period.

6. Refund Policy

Dodo, as our merchant of record, handles all billing and refund processing. Subscription fees are generally non-refundable. Specific refund terms:

• Subscriptions — No refunds for partial billing periods. If you cancel, you retain access until the end of your current period. No prorated refunds are issued for early cancellation.
• Credits — Purchased credits are non-refundable and have no cash value.
• Annual plans — No refunds after the first 14 days of an annual subscription. Within the first 14 days, you may request a full refund by contacting support@infograph.ai.
• EU consumers — If you are in the European Union, you have a 14-day cooling-off period from the date of purchase during which you may cancel for a full refund, as required by EU consumer protection law.

To request a refund, contact support@infograph.ai with your account email and transaction details. Refund requests are processed by Dodo and typically resolved within 5-10 business days.

7. Your Data

You retain ownership of all data you upload to, create within, or generate through the Service ("Your Data"), including uploaded files, project configurations, dashboards, and AI-generated output. We claim no ownership of Your Data.

You grant us a license to use, process, and store Your Data to operate and provide the Service to you. We may also use anonymized and aggregated data (from which you cannot be identified) to improve the Service, including for analytics, benchmarking, and model improvement. We do not use your raw, identifiable data to train AI models. See our Privacy Policy for details.

You are responsible for ensuring you have the right to upload and process any data you provide to the Service, including data accessed through connected third-party sources (such as Google Sheets or Microsoft OneDrive via Nango).

Prohibited Data

You must not upload or process the following types of data through the Service:

• Protected health information (PHI) under HIPAA or equivalent laws
• Government-issued identifiers (Social Security numbers, passport numbers, etc.)
• Payment card numbers or financial account credentials
• Biometric identifiers
• Data belonging to children under 16

We are not liable for any consequences arising from your upload of prohibited data.

8. AI-Generated Output

The Service uses Anthropic's AI models to generate dashboards, visualizations, code, and other output. You should be aware that:

• AI output may contain errors, inaccuracies, or unexpected results.
• Similar inputs may produce identical or similar outputs for different users.
• We do not guarantee that AI output is unique, free of third-party rights, accurate, complete, or suitable for any particular purpose.
• You are solely responsible for reviewing and validating all AI-generated output before relying on it.

The Service does not provide professional, financial, legal, or medical advice. Do not rely on AI output for critical decisions without independent verification.

9. Intellectual Property

The Service, including its software, design, features, documentation, and underlying technology, is owned by Infograph AI and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with your subscription plan. All rights not expressly granted are reserved.

If you provide feedback, suggestions, or feature requests, you grant us a perpetual, royalty-free license to use that feedback for any purpose without obligation to you.

10. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Attempt to extract or reconstruct AI model weights, training data, or algorithms
• Use the Service to build a competing product or train competing AI models
• Use automated tools (bots, scrapers) to access the Service without prior written consent
• Bypass or circumvent security measures, access controls, or rate limits
• Upload malicious code, viruses, or harmful content
• Interfere with or disrupt the Service or its infrastructure
• Resell, sublicense, or share your account access with unauthorized third parties
• Misrepresent AI-generated output as human-created in contexts where the distinction matters

11. Shared Content

The Service allows you to share dashboards and projects via public, private, or password-protected links. When you share content publicly, it becomes accessible to anyone with the link. For password-protected shares, you are responsible for the strength and confidentiality of the password you choose. You are solely responsible for the content you share and must ensure it does not infringe on third-party rights or violate applicable laws. We reserve the right to remove shared content that violates these Terms.

12. Third-Party Services

The Service integrates with third-party providers including Clerk (authentication), Dodo (payments), Anthropic (AI models), AWS (infrastructure), Nango (data source integrations), and Cloudflare (hosting and security). Your use of features involving these providers may be subject to their respective terms of service. We are not responsible for the availability, accuracy, or conduct of any third-party service.

13. Disclaimer of Warranties

THE SERVICE, INCLUDING ALL AI-GENERATED OUTPUT, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, INFOGRAPH AI AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE.

15. Indemnification

You agree to indemnify and hold harmless Infograph AI from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any applicable law or third-party rights, or (d) Your Data, including any claim that it infringes or misappropriates third-party rights.

16. Termination

You may close your account at any time by contacting support@infograph.ai. We may suspend or terminate your account immediately if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or used the Service unlawfully.

Upon termination, your access to the Service ends immediately. Your Data is retained for 90 days following termination, after which it is permanently deleted. Sections of these Terms that by their nature should survive termination will remain in effect, including intellectual property rights, disclaimers, limitations of liability, and indemnification.

17. Export Controls

You may not use the Service if you are located in a country subject to comprehensive sanctions (including Cuba, Iran, North Korea, Russia, Syria, and the Crimea, Donetsk, or Luhansk regions) or if you are on any applicable restricted party list. You represent that your use of the Service complies with all applicable export control and sanctions laws.

18. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days notice via email or a prominent notice within the Service. Your continued use after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

19. Governing Law

These Terms are governed by the laws of the Cayman Islands, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of the Cayman Islands. You consent to the exclusive jurisdiction of those courts.
